Probate Process

Person Dies With a Will (Generally):

•Determine if Will is Valid (Testator Sign, 2 Witnesses Sign & Self-Proved)

•Is anyone contesting the validity of the will?

•Did decedent receive Medicaid benefits after March 1, 2005? If so, need MERP Authorization from Medicaid.

•File Application for Probate of Will (minimum of 10 days for posting)

•Hearing held for Letter of Testamentary (appointment of executor) once posting has been returned. If only real property and vehicles in estate and no debts owed, often a limited probate can be filed, where no executor is appointed. The order signed by the court is used to transfer title to the property of the estate.
